The process when buying property in Vietnam

The foreigner who has entry visas to Vietnam can buy house according to the following steps:

Step 1: Finding a Real Estate agency in Vietnam (Fee/ Free)

Do you really know the market? Do you have many options for choosing? Do you love paperwork? 

 If the answer for those questions is NO, then you will need an agency to handle it for you. 

When planning on buying property or setting up a company in Vietnam, it is wise to seek advisory beforehand.

Having yourself an agent will help you to save time,get access to more available properties, and they will help you with documentation and negotiations.

Good agents should have a wealth of information to help you make a good  decision. 

The services of agents are usually free to buyers, fees are usually paid by the seller.

Step 2: Sharing your requirements

Beside listening to the reality from the agent beside your research, Talking about your wants – needs and status are necessary  when buying a home. 

From checking your budget, your cash flow; Picturing your dream type of house, Considering the area, the number of bedrooms; Choosing a person to name on the contract,… All of this can help you clear your mind before making any decision. 

Step 3: Considering the options: 

In Vietnam, foreigners can buy  apartments in commercial housing projects. The agent will share more about market  information, then choose reputable projects and investors to minimize risks. It is essential to check whether the apartment or project is eligible for sale to foreigners in accordance with Vietnamese law.

Is buying your dream house possible in this market or should you search for it somewhere else? 

 Which project do you like the most? Which one seems suitable? How many are available?

Step 4: Experiencing the sample house/ real house

After considering the options, let’s pick the 3 ones that you find possible and experience it. 

You can see the way home, meet the neighbors, check the house from the inside to the outside. 

Be aware of how the house is sold, furnished or without furniture,  calculate expenses that’s necessary  to be ready to live,… 

If the options are from the new projects, you may see the sample house instead of a real house. When visiting it, you can also ask more about the investor, developer, time of handing over, regulations about pets, building and warranty,…etc. 

There is a chance for you to know more about this option, A picture is worth a thousand words. Should not skip it.

Step 5: Choosing property.

Well, you are halfway to finish. After giving you some time to compare and consider, you have the picture in your mind. Again these questions:

Is buying your dream house possible in this market or should you search for it somewhere else? 

 Which project do you like the most? Which one seems suitable? If you have a chance and opportunity, go ahead. Let’s choose your best option! It’s time to make a decision!

Step 6: Providing documents to buy

According to the Vietnamese Law on Housing 2014, foreign investors or citizens with adequate finances can buy properties across the country as long as they meet Vietnam’s entry requirements.

So, here you will need at least one of these ( Depends on the Project’s procedure) : Visa / Passport / Temporary resident card. 

And, if you want to use your foreign company to buy the house, depends on the project you buy, besides providing the representative’s ID, You will also need to submit: Investment registration certificate, Business registration Certificate ( optional), Passport of  a representative, Work Permit (Optional), Work Contract (Optional). 

The agent will also give you more documents for registering, read carefully and make sure you understand all the meaning and procedure. 

Step 7: Making a deposit. 

After choosing a suitable apartment, foreigners can sign a deposit agreement. The deposit amount depends on the agreement of the parties or the investor of each project. The deposit will be deducted from the amount you pay when you buy the home.

The deposit will also determine the value of the house, the time of signing the sale and purchase contract and other relevant terms. The value of houses in Vietnam depends on each area, each project and according to the agreement of the parties.

Step 8: Signing a sell & purchase contract, making payment.

Now you can sign a house purchase contract with the project investor. The housing purchase contracts for foreigners will stipulate the rights and obligations of the parties. Remember to read all the tém & conditions as well as rights & obligations. There will be concerns, just ask your agent to make it clear. 

The foreigner can pay for a house in Vietnam in one of the following ways:

  • Transfer money from a person account ( any bank in Viet Nam) to the seller’s account
  • Transfer money directly from your bank account from your home country to the seller’s account
  • Pay by cash.

Step 9: Following the payment process & (optional)Applying for a Home Ownership Certificate/Pink Book for foreigners.

Many projects start to sell since they are not done yet, the investors will have the long term payment and that makes it easier to pay or benefit your cash flow. 

As the terms and conditions on your contract,  Just follow the schedule for the payment and pay it on time. Remember the important time:

  • Signing the contract: Pay 30%
  • Receiving the apartment: Pay up to 95% ( +2%  Maintenance fee)
  • Applying for the certificate: 100% 

After receiving the apartment, foreigners can carry out the procedures for applying for a pink book. Or foreigners can also provide documents for the investor to apply for a pink book for them.

Step 10: Giving your comments/ rating about the services

Congratulations! Now you have your own home in Viet Nam. Do you want to  share your experience?
